BACK TO HOME 2007 ISAIAH BREEDING CONTRACT
one contract per mare
This contract is made by and between Laura & Tom Patterson dba Mission Bay Farm, hereinafter named Stallion Owner, and _____________________________________, hereinafter named Mare Owner for breeding of the mare _____________________________ to the stallion ISAIAH for the 2007 breeding season (February 1 through August 31) and is subject to the terms and conditions found within this contract.
Fees and Terms:
The Mare Owner shall pay the stud fee of $1000 in its entirety before the first shipment of semen is made. The first collection of semen is included in the stud fee. An additional collection fee of $150 will be charged for any subsequent collections and must be paid prior to shipment of semen. Breeding purchased through a Stallion Service Auction does not include the first collection at no charge.
A deposit of $100.00 is also due to cover shipping costs and container fee. Any unused balance will be refunded following the end of the 2007 breeding season. In lieu of the $100.00 deposit said Mare Owner can submit a credit card payment via PayPal (see attached info).
All fees are outlined in the attached fee schedule. If additional shipments are needed by Mare
Owner another $100 deposit may be required before any further shipments and collections are
made.
The Mare Owner must also submit the Mare Questionnaire with this contract, which includes a copy of said mare’s registration papers and a picture (copies are acceptable). If Mare Owner sends in original picture of mare and would like the picture to be returned, they must supply a self addressed stamped envelope.
It is the Mare Owner’s responsibility to ensure the breeding soundness of said mare prior to insemination. Stallion Owner recommends a current uterine culture, taken by a licensed veterinarian, when the mare is in heat and submitted to a recognized laboratory, showing that the mare in this contract is in sound breeding condition.
Semen must be handled and administered by a licensed veterinarian.
Live Foal Guarantee:
If the mare stated in this contract does not conceive or deliver a live foal that stands and nurses
unassisted, and the stud fee was paid in full, the Mare Owner shall be entitled to re-breed the
mare for the next 2 (two) consecutive breeding seasons. In the event that the foal is stillborn, is
aborted or fails to stand and nurse, and in order to maintain this guarantee, the Mare Owner
agrees to notify the Stallion Owner within 72 hours and provide a detailed statement affirming
proper care of the mare during gestation, including but not limited to; rhinopneumonitus
vaccinations at 5, 7 and 9 months, attended to mare during foaling, and proper nutrition.
This detailed statement must be completed by a licensed veterinarian within 10 days following
notification to Stallion Owner.

If the mare does not produce a live foal that stands and nurses unassisted for 24 hours within the 2 (two) consecutive breeding seasons, this contract shall become null and void, and no refunds, rebreedings, or fees shall be returned.
Mare Owner assumes all responsibility for the condition of the mare and shall bear all risk of loss and damage to the mare and agrees to hold the Stallion Owner harmless for any and all
damages.
If the mare does not get in foal, dies or becomes unfit for breeding, another mare may be
substituted but only with the consent of the Stallion Owner. It is agreed that if the stallion dies or
becomes unfit for service then frozen semen, if available, will be used instead and Mare Owner
will be subject to all applicable fees of handling and shipping said frozen semen. If no frozen
semen is available and the stud fee has been paid in its entirety, then the stud fee shall be
returned to the Mare Owner.
Mare Owner understands that if ISAIAH is away at a competition when semen is requested then
frozen semen, if available, can be shipped instead. If mare owner wishes not to use frozen semen then mare owner may have to wait until the said mare’s next breeding cycle. Once stud fee is paid a competition schedule will be provided.
Advanced Notice:
It is the Mare Owner’s responsibility to notify the stallion owner of the first day the mare is in
season. At least 24 hours advance notice must be given to the Stallion Owner before the semen
collection is made. Every effort will be made by Stallion Owner to accommodate same day
collection and shipment requests but no guarantees are made. All orders for semen will be filled as received, subject to availability of the Stallion's semen. Mare Owner must call Stallion Owner to schedule a collection.
Mare Owner must have a licensed veterinarian or breeding technician responsible for the
insemination process. Written verification of the exam may be requested by the stallion owner.
The Mare Owner agrees that the Stallion Owner’s sole responsibility is to provide live semen in
viable condition to Mare Owner’s requested facilities.
If possible 2 (two) doses of semen will be sent and must be used only for mare named herein.
If an Equitainer is used it must be returned to Stallion Owner within 3 (three) days after
insemination via UPS or Fed Ex 2 nd Day Air. After three days there will be a late container fee of
$50 per day. This is to insure that the Equitainer is returned in a timely fashion and will be able to cover all shipments. The Equitainer must be returned clean and undamaged. If ballast bags,
coolant cans or containers are missing or damaged, Mare Owner will be charged for replacement at cost.
Registration:
Stallion Owner agrees to provide a breeding certificate to the Mare Owner’s registry of
preference as indicated on the Mare Questionnaire, provided the Mare Owner has met the
conditions of this contract. Mare Owner understands that in order to receive a breeding certificate from the requested registry, that the mare named herein, must already be approved for breeding or must meet all approval requirements to enter one of the registries’ studbooks.
All fees to have mare approved for breeding with any registry and/or have foal inspected is the responsibility of the Mare Owner
Mare Owner is responsible for having a 45 to 70 day pregnancy examination performed on said
mare and notifying Stallion Owner of the results, as well as sending in the signed Insemination
certificate that will be sent with semen shipment so that the breeding certificate can be sent.
Non-Assignment:
This contract cannot be assigned or transferred by the Purchaser. There is no right of return to the stallion if the Mare is sold or otherwise changes ownership after having been served by the
stallion.
This contract shall be interpreted, construed and governed by the laws of the State of Texas. Any disputes of a legal matter must be settled in Brazos County, Texas.
I the undersigned do hereby certify that I am the Mare Owner named herein, or a duly authorized agent thereof, and as such have the authority to enter into this contract, as witness by my signature. I also certify that I have read and understand this contract and fee schedules. This contract is binding upon both parties when signed.
